5. Intellectual Property and Infringement Reports
Organizations that use CalendarFundraiser (each an "Organizer") are solely responsible for the content they post, including names, logos, images, and other materials, and must not post content that infringes the intellectual-property rights of others.
If you believe content on the Website infringes your intellectual-property rights, you may submit a report to support@calendarfundraiser.com or through our Contact Us page. Please include:
- Your full name, organization (if any), and your relationship to the rights holder;
- Your contact email, phone (optional), and mailing address;
- A description of the intellectual property at issue (for example, a trademark and its registration number, or a copyrighted work) and proof of ownership where available;
- The location of the allegedly infringing material (campaign URL, organization name, or a screenshot);
- A description of how the material infringes your rights;
- A statement that you have a good-faith belief that the use of the material is not authorized by the rights holder, its agent, or the law; and
- A statement that the information in your report is accurate and that you are the rights holder or are authorized to act on the rights holder's behalf, together with your signature (typed name) and the date.
We acknowledge infringement reports within one to two business days and review each report. Where infringement is identified, we may remove or disable the infringing content, take the affected campaign offline, and/or suspend or terminate the Organizer's account. We notify the affected Organizer, who may submit a counter-statement; we may restore content if the matter is resolved or withdrawn. We maintain a repeat-infringer policy and will terminate the accounts of Organizers who repeatedly infringe intellectual-property rights.
6. Payments, Payouts, Refunds, and Chargebacks
Donations are processed by third-party payment providers (such as Stripe and PayPal). When an Organizer connects a payout account, donation funds settle directly into that Organizer's own connected payment account. Calendar day amounts are paid to the Organizer in full. Where a donor adds an optional "boost" on top of a donation, or where an Organizer prices calendar days above face value using a multiplier, CalendarFundraiser retains a platform share of twenty percent (20%) of the amount above face value plus 2.9% for card processing; the remainder is paid to the Organizer. Donor service fees are paid by the donor in addition to the donation and are retained by CalendarFundraiser. The donor service fee is determined by the highest-numbered calendar date in the checkout — currently $1 for the 1st, $2 for the 2nd and 3rd, $3 for the 4th, $4 for the 5th through 7th, $5 for the 8th through 19th, $6 for the 20th through 25th, and $7 for the 26th through 31st — plus $2 for each additional date claimed in the same checkout. The fee includes third-party card-processing costs, may be rounded up to the next whole dollar, and is displayed to the donor before payment. CalendarFundraiser may update this schedule from time to time; the amount shown at checkout governs. The Organizer is the merchant of record for donations made to its campaigns and is solely responsible for the underlying fundraiser, for any goods, services, or benefits it offers to donors, and for handling all donor questions, refunds, disputes, and chargebacks relating to its campaigns.
Payout timing and reserves. To help cover potential refunds, disputes, and chargebacks, payouts to an Organizer's bank account may be delayed for a period after each donation (for example, several business days). We (or our payment providers) may adjust payout timing, place holds, or require reserves where reasonably necessary to manage risk, and may pause payouts on accounts with unusual dispute or chargeback activity.
Organizer responsibility for losses. The Organizer is responsible for all refunds, chargebacks, disputes, reversals, fines, and negative balances arising from donations to its campaigns. If CalendarFundraiser or its payment providers are required to advance, cover, or become liable for any such amount on the Organizer's behalf — including any associated fees or penalties — the Organizer agrees to promptly reimburse those amounts in full. The Organizer authorizes CalendarFundraiser and its payment providers to recover such amounts by deducting them from the Organizer's current or future payout balances or connected account, by charging a payment method on file, or by other lawful means. This obligation survives termination of the Organizer's account.
Donors. If you are a donor and wish to request a refund or dispute a donation, please first contact the Organizer of the campaign or reach us at support@calendarfundraiser.com so we can help resolve the matter.
7. Acceptable Use of Fundraising Campaigns
CalendarFundraiser is for genuine donation-based fundraising: supporters claim calendar dates and give the corresponding amount, with nothing promised in return. To comply with the law and the rules of our payment providers (including Stripe and PayPal), the following are prohibited on any campaign:
- Raffles, sweepstakes, lotteries, or any game of chance or skill offering prizes, entries, or winnings in exchange for a donation. A donation may never be positioned as the purchase of a chance to win something.
- Selling goods or services through a campaign page. Campaigns collect donations only; they are not storefronts.
- Fundraising for any business, product, or category on Stripe's Prohibited and Restricted Businesses list or PayPal's Acceptable Use Policy, including (without limitation) adult content or services, marijuana/CBD/THC products, weapons, illegal drugs, or gambling.
- Personal money transfer disguised as fundraising — using a campaign to move money between individuals or entities other than bona fide donations to the stated cause.
- Misrepresenting the Organizer's identity, the cause, or how funds will be used.
CalendarFundraiser reviews campaigns and may pause or remove any campaign, withhold publishing, or suspend or terminate an Organizer's account — with or without notice — where we reasonably believe a campaign violates this section, the law, or a payment provider's rules. Where a payment provider requires it, we may also share campaign information with that provider. If you are unsure whether your fundraiser is permitted, contact support@calendarfundraiser.com before publishing.
8. Changes to This Policy
We may update these Terms of Service periodically. Changes will be posted on this page. For significant updates, we may notify you by email.
